Article 1845 - Legacy of a thing charged with encumbrances - If the bequeathed thing is encumbered with any emphyteutic rent, share in the rent, easement or any other encumbrance inherent thereto, it shall pass to the legatee with the same encumbrance. § Sole paragraph – If, however, the thing is burdened with arrears of emphyteutic rent, of shares in the rent or of other onus these shall be paid out of the inheritance.
