Section 2122. Deduction of encumbrances in rem in the partition

Article 2122 - Deduction of encumbrances in rem in the partition - Where the immovable assets are enlisted for the partition alongwith the said charges, or any other charges they shall be valued as if there were no charges; thereafter the capital corresponding to the charge shall be deducted and the heir, who remains with the immovable asset, shall exclusively pay the said charge.
