Portuguese Civil Code, 1867

Article 2219 – Preservation of the usufruct - The usufructuary may avail of all the remedies available to an owner in order to retain his usufruct. § 1 - The costs of litigation shall however be to the account of the usufructuary if the usufruct has been granted gratuitously. § 2 - If the usufruct has been granted by onerous title, whatever has been stated in connection with eviction shall be observed.
