Article 697 – Effects of annulment - After the contract is rescinded, each of the contracting parties shall get back whatever has been given by him, or its value, if the restoration in kind is not possible. § 1 - In the cases of mistake, which does not arise from fraud or bad faith, there is no obligation to restore fruits or benefits. § 2 - In the cases where there is fraud or bad faith, there is an obligation to pay compensation.
