Portuguese Civil Code, 1867

Article 731 – Joint debtors - Whenever there are different debtors obliged to deliver the same thing, they will be liable proportionately, except; 1. Where each of them has assumed joint liability; 2. Where the performance is relating to certain and specified thing which is in possession of one of them and which is dependent on action which only he can satisfy; 3. Where the agreement provides differently.
