Section 77. Succession of surviving spouse.

77. Succession of surviving spouse.— 9[In default of descendants, the surviving spouse shall succeed], provided that at the time of the death of the other spouse, they were not divorced or there had been no judicial separation of spouses and assets by a decision which had become final.
