45. Magistrate’s power to impose enchanced penalties. Nowithstanding anything contained in 1[section 29 of the Code of Criminal Procedure, 1973 (2 of 1974)], it shall be lawful for any Court of a Judicial Magistrate of the first class to pass any sentence authorised by this Act in excess of its powers under the said section.
