40. Previous sanction of Competent Authority for prosecution.— No prosecution for any offence punishable under this Act shall be instituted except with the previous sanction of the Competent Authority: 1[Provided that, for prosecution for the offence punishable under section 3Z-2, no such previous sanction of the Competent Authority shall be necessary.]
