Section 38. Composition of offence

38. (1) Any offence made punishable by or under this Act, except offence under sub-section (3) of section 35, may either before or after the institution of proceedings be compounded by the Authority or any officer authorized by it in that behalf on such terms and for such amount as the State Government may, by notification in the Official Gazette, specify in this behalf. (2) Where an offence has been compounded under sub-section (1) above, the offender, if in custody, shall be discharged and no further proceedings shall be taken against him in respect of the offence.
