The West Bengal Housing Industry Regulation Act, 2017

This Act was repealed on 4 May 2021 by struck down as beyond the State's legislative power by the Supreme Court in Forum for People's Collective Efforts v. State of West Bengal (4 May 2021); it may still apply to matters that began before then.

86. (1) The West Bengal Building (Regulation of Promotion of Construction and Transfer by Promoters) Act, 1993 is hereby repealed. (2) Notwithstanding such repeal, — (a) the provisions of the said enactments shall apply in relation to any proceeding relating to any real estate project which commenced before this Act came into force unless otherwise agreed by the parties but this Act shall apply in relation to proceedings which commenced on or after this Act comes into force; (b) all rules made and notifications published, under the said enactment shall, to the extent to which they are not repugnant to this Act, be deemed respectively to have been made or issued under this Act.
