Section 39. Removal of Councillors for misconduct, etc.

39. Removal of Councillors for misconduct, etc.— The State Government may, if it thinks fit, on the recommendation of the Zilla Parishad supported by 7[not less than two-third of the number of Councillors] present and voting, remove any Councillor if he has been guilty of misconduct in the discharge of his duties, or of any disgraceful conduct, or has become incapable of performing his duties as a Councillor : Provided that, no such Councillor shall be removed from office unless he has been given reasonable opportunity to furnish his explanation.
